In consideration of you accepting this entry, I, the participant, intending to be legally bound do hereby waive and forever release any and all rights and claims for damages or injuries that I may have against the Event Director, RunSignup.com, and all of their agents assisting with the event, sponsors and their representatives, volunteers and employees for any and all injuries to me or my personal property. This release includes all injuries and/or damages suffered by me before, during or after the event. I recognize, intend and understand that this release is binding on my heirs, executors, administrators, or assignees.
I know that running a road race is a potentially hazardous activity. I should not enter and run unless I am medically able to do so and properly trained. I assume all risks associated with running in this event including, but not limited to: falls, contact with other participants, the effects of weather, traffic, and course conditions, and waive any and all claims which I might have based on any of those and other risks typically found in running a road race. I acknowledge all such risks are known and understood by me. I agree to abide by all decisions of any race official relative to my ability to safely complete the run. I certify as a material condition to my being permitted to enter this race that I am physically fit and sufficiently trained for the completion of this event and that a licensed Medical Doctor has verified my physical condition.
In the event of an illness, injury or medical emergency arising during the event I hereby authorize and give my consent to the Event Director to secure from any accredited hospital, clinic and/ or physician any treatment deemed necessary for my immediate care. I agree that I will be fully responsible for payment of any and all medical services and treatment rendered to me including but not limited to medical transport, medications, treatment and hospitalization.
As it applies to my participation in this race, I agree to abide by the Center for Disease Control (CDC)’s recommendations for the prevention of the spread of COVID-19 and attest to having read the CDC’s guidance at: https://www.cdc.gov. I also agree to abide by any COVID-19 distancing and other safety guidelines issued by the state, the community or by this race for my participation in this race.
Further, I grant permission to all the foregoing to use my name, voice and images of myself in any photographs, motion pictures, results, publications or any other print, videographic or electronic recording of this event for legitimate purposes.
This event follows the standard running industry policy: All entry fees are non-refundable. We reserve the right to postpone or cancel the event due to circumstances beyond our control such as a natural disaster or emergency or as required to protect the safety of participants and staff. No refunds will be issued under these circumstances. We reserve the right to change the details of the event without prior notice. I understand that my entry fee is nonrefundable and bib numbers are non transferable.

WAIVER: MUST BE COMPLETED FOR ENTRY TO BE ACCEPTED. I HEREBY FOR MYSELF, MY MINOR CHILD (IF APPLICABLE), MY ADMINISTRATORS, HEIRS AND
ASSIGNEES, DO HEREBY RELEASE, DISCHARGE, AND INDEMNIFY DC MULTISPORT; EVENT VOLUNTEERS; THE ORGANIZERS OF THIS EVENT, THEIR SPONSORS,
ASSOCIATES, CONTRACTORS; MEMORIAL HOSPITAL AND HEALTH CARE CENTER, ITS BOARDS, EMPLOYEES, AND VOLUNTEERS; OTHER ENTRANTS AND
REPRESENTATIVES; AND THE CITY OF JASPER, ITS BOARDS, ELECTED AND APPOINTED OFFICIALS, AND ITS EMPLOYEES, FOR PROPERTY DAMAGE OR PERSONAL
INJURY, INCLUDING DEATH, THAT MAY ARISE OR GROW OUT OF MY (OR MY MINOR CHILD’S) PARTICIPATION IN THIS DC MULTISPORT EVENT. I CERTIFY THAT I HAVE
PREPARED FOR THIS EVENT AND AM IN ADEQUATE PHYSICAL CONDITION FOR THIS EVENT. I AGREE TO FOLLOW THE RULES OF THIS EVENT, OBEY ALL TRAFFIC LAWS,
AVOID LITTERING, AND RESPECT THE PROPERTY OF OTHERS. I ALSO AGREE TO INDEMNIFY AND HOLD HARMLESS THE CITY OF JASPER, ITS BOARDS, ELECTED AND
APPOINTED OFFICIALS, AND ITS EMPLOYEES AND ALL OTHERS INVOLVED IN THIS EVENT FROM ANY CLAIM, DAMAGES, EXPENSES OR ACTION, INCLUDING ATTORNEY
FEES, ASSESSED OR BROUGHT AGAINST THEM BECAUSE OF MY ACTS OR OMISSIONS OR THE ACTS OR OMISSIONS OF MY MINOR CHILD.
In consideration of DC Multisport permitting me and/or my minor child(ren) (if applicable) (jointly and severally the “Participant”) to participate in DC Multisport events or activities, the Participant, Participant’s heirs, next of kin, assigns, and personal representatives, do hereby enter into this Waiver, Consent and Liability
Release (“Waiver and Consent”) and agree as follows:
1. Participant understands that bicycling, running, canoeing, distance walking, and other activities require physical conditioning, and Participant represents that Participant is in sound medical condition, capable of participating in DC Multisport events, rides, and activities without risk to Participant or others. Participant has no known medical impediment which would endanger Participant or others. Participant agrees that Participant will be solely responsible for the condition and adequacy of safety gears equipment. Participant will participate within the limits of the Participant's own abilities, Participant's equipment, and the current conditions, and in a manner so as not to endanger either Participant or others.
2. Participant understands that Participant's name, address, phone number, email address, photograph, voice, and/or likeness may be used in promotional or advertising materials. Participant consents to such uses and waives any rights of privacy or publicity Participant may have in connection with those uses.
3. Participant understands that bicycling, running, canoeing, distance walking, and other activities are potentially hazardous which involve risks, inherent and otherwise, known or unknown, that cannot be eliminated, which may cause injury, illness, paralysis, or death to Participant, other persons, and/or damage to property. Participant certifies that Participant has prepared for this event and is in adequate physical condition for this event.
4. Participant agrees to follow the rules of the DC Multisport and the City of Huntingburg, obey all traffic laws, avoid littering and respect the property of others.
5. Participant further understands that negligence of DC Multisport, including its officers, members, volunteers, and sponsors, or other risks associated with DC Multisport events or activities may cause injury, illness, paralysis, or death to Participant, other persons, and/or damage to property. Some of the risks associated with DC Multisport events, rides, and activities include, but are not limited to known or unknown medical conditions. Participant assumes full and sole responsibility for all risks, both known and unknown, inherent or otherwise, related to the DC Multisport events, rides, and activities on behalf of Participant. Further, Participant acknowledges that Participant is voluntarily participating in this activity with knowledge of the risks and fully accepts and assumes all risks related to or arising from DC Multisport events, rides and activities.
6. Acknowledging that such risks set forth above exist, Participant, on Participant's own behalf and those of Participant's executors, heirs, and assignees, does HEREBY
RELEASE, DISCHARGE, HOLD HARMLESS AND INDEMNIFY DC Multisport, its officers, directors, employees and volunteers, the organizers of this DC Multisport Event, their sponsors, associates and contractors; Visit Dubois County, its boards, employees, and volunteers; other entrants and representatives; and the City of JASPER, its boards, elected and appointed officials, and its employees and agents and the officers, directors, employees, representatives, agents, insurers, and successors of all the above (hereinafter individually and collectively referred to as the"Releasees") from any and all claims, damages, losses, actions, suits, proceedings, breach of contract actions, wrongful death actions, negligence of Releasees, acts or omissions of Releasees, expenses, attorney fees, and liability that Participant, anyone on Participant's behalf, Participant's heirs, next of kin, or minor child(ren) may have for, or relating to, any property damage and/or injury, including death, to Participant suffered or claimed to have been suffered by Participant which may arise out of or is related in any manner, either directly or indirectly, to Participant's participation in any DC Multisport event, ride, or activity or Participant's assistance at any DC Multisport event, ride, or activity. Participant FURTHER AGREES TO INDEMNIFY AND HOLD HARMLESS the Releasees and all others involved in this event from any claim, damages, expenses or action, including attorney fees, assessed or brought against them because of Participant's acts or omissions.
7. DC Multisport volunteers have no duty to indemnify, defend, or hold harmless the Releasees.
8. This Waiver, Consent and Liability Release is governed by the laws of the State of Indiana. If one or more portions of this Waiver and Release are found unenforceable, the remainder of this Waiver, Consent and Liability Release will remain enforceable. If Participant is a minor, Participant's parent or guardian is also signing individually and on Participant's behalf, and we both agree to be bound by the terms of this Waiver, Consent and Liability Release.
9. Participant has read and fully understands this Waiver, Consent and Liability Release; Participant agrees to be bound by its terms, and agrees to this Wavier, Consent and Liability Release freely and willingly with the submission of their registration. Participant understands that by submitting this registration, Participant may be waiving certain legal rights, including the right to sue DC Multisport or any of the Releasees.
10. There is an inherent risk of exposure to COVID-19 exists in any public place where people are present. COVID-19 is an extremely contagious disease that can lead to severe illness and death. The participant and individual observers assume all risk in participating or observing this event, noting that there is a risk of exposure.
11. Participants agree to cooperate and practice proper COVID -19 procedures as required by DC Multisport, Visit Dubois County, the City of JASPER or the State of Indiana.
By submitting this entry, I acknowledge (or a parent or adult guardian for all children under 18 years) having read and agreed to the above release and waiver including the no refund policy.
